These Terms of Service (“Terms”) are a binding contract between you (“you,” “your,” or “User”) and Better Human, Inc. (“Better Human,” “we,” “us,” or “our”) and govern your access to and use of our website (www.betterhumanclub.com), mobile app, at-home blood testing kits, AI-powered insights, supplements, employer wellness programs, and all related services (collectively, the “Services”).
PLEASE READ THESE TERMS CAREFULLY. By clicking “I Accept,” downloading the app, purchasing a kit, or otherwise accessing or using the Services, you agree that you have read, understood, and are bound by these Terms, including the arbitration agreement and class-action waiver in Section 18. If you do not agree, do not use the Services.
Better Human is not a healthcare provider and does not provide medical advice, diagnosis, or treatment. The Services (including blood-test results, risk scores, biological-age modeling, action plans, supplement recommendations, and AI insights) are for wellness optimization and educational purposes only. No material on the Services is intended as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making any changes to your health regimen. Reliance on the Services is at your sole risk.
Telehealth consultations are provided solely by independent licensed physicians with whom you form a direct doctor-patient relationship. Better Human only provides the platform and facilitates secure data transmission. Physicians are solely responsible for any clinical decisions, diagnoses, treatment plans, or prescriptions.
You must be at least 18 years old and capable of forming a binding contract. By using the Services you represent and warrant that you meet these requirements.
You must create an accurate account and keep your password secure. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts for violations of these Terms.
Certain features require a recurring subscription. Subscriptions automatically renew monthly unless cancelled before the renewal date through your account settings.
Payments are processed by third-party payment processors. You agree to pay all fees when due. Prices may change with notice and will apply to future renewals.
Partial Results / QNS: If a sample cannot be fully analyzed we may provide partial results and may offer a replacement kit or credit at our discretion.
Kit Credits: If you already have two unused kits we may issue a credit instead of shipping another kit.
Refunds: See our separate Refund Policy.
Certain individuals should not use the blood-collection device including those with vasovagal syncope, bleeding disorders, anticoagulant therapy, compromised circulation, or skin conditions impairing healing. Use is at your own risk.
You retain ownership of your data but grant us a worldwide, royalty-free license to use, modify, and create derivative works from data you provide. De-identified or aggregated data may be used for research or AI model improvement.
Employers receive only aggregated or anonymized health insights. No individually identifiable data is shared without employee consent.
All Services, AI models, and platform content are owned by Better Human. You receive a limited, revocable license for personal use only.
We rely on third-party laboratories, payment processors, APIs, and cloud infrastructure providers. Their terms may also apply.
Certain features within the application may use artificial intelligence ("AI") technologies to provide health insights, conversational assistance, and wellness-related recommendations.
By using AI-powered features, users acknowledge and agree that:
Users should consult qualified healthcare professionals for medical decisions or emergencies.
Users may decline AI-powered functionality by not providing consent during the in-app disclosure flow.
AI Disclaimer: AI-generated content is not intended to replace professional medical advice, diagnosis, or treatment.
We may modify or discontinue parts of the Services at any time without liability.
We may suspend or terminate accounts for breaches of these Terms.
You agree to indemnify and hold Better Human harmless from claims arising from your use of the Services.
The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind.
To the maximum extent permitted by law, our liability will not exceed $100 USD.
